9.8 I am seeing a therapist. Will that hurt my chances of getting custody?

If you are seeing a therapist, acknowledge yourself for getting the professional support you need. Your well being is important to enable you to be the best parent you can be.

Talk over with your lawyer the implications of your being treated by a therapist. It may be that the condition for which you are being treated in no way affects your child or your ability to be a loving and supportive parent. It may be that your history of actively addressing whatever issues are involved is the single best thing you could do for your position in court.

Your mental health records may be subpoenaed by the other parent’s lawyer. For this reason it is important to discuss with your attorney an action plan for responding to a request to obtain records in your therapist’s file. Ask your attorney to contact your therapist to alert him or her regarding how to respond to a request for your mental health records.
